Service Terms & Conditions

These Service Terms & Conditions cover specific course and subscription types, and are subject to the Teaching Channel Terms of Use and Copyright Terms that following these Service Terms & Conditions (the “Terms”). Capitalized terms shall have the meaning set forth in the Terms.

Teaching Channel Elevate and Evolve Courses with Learners Edge

A. Individual Continuing Education Course(s) Purchase Terms & Conditions

Applicable to All: Continuing Education (OL), Fast Track (FT) and Hybrid/Blended Learning (OS) Courses

  1. Curriculum

    Continuing education graduate level courses completed through Teaching Channel and your chosen accredited University Partner are intended to fulfill requirements for license renewal and/or salary advancement. Teaching Channel courses have proven successful for contractual lane changes in thousands of districts in the United States. Districts and states have different requirements for license renewal and salary advancement; you may need to check with district personnel to gain prior approval.

  2. Term Details

    1. Continuing Education Courses (OL)
      • You are responsible for completing your course within the term for which you registered
      • Spring Term: Coursework due April 15 – or next business day
      • Summer Term: Coursework due August 15 – or next business day
      • Fall Term: Coursework due November 15 – or next business day
        Please note: you may register for and complete up to 15 credits per term (dependent upon University Partner selection).
    2. Fast Track Courses (FT)
      • You are responsible for completing your course within the term for which you registered
      • Spring Term: Coursework due May 30 – or next business day
      • Summer Term: Coursework due August 30 – or next business day
      • Fall Term: Coursework due December 9 – or next business day
        Please note: you may register for and complete up to 15 credits per term (dependent upon University Partner selection).
    3. Hybrid/Blended Learning Courses (FT)
      • Please note registration is contingent upon the following enrollment parameters. 
        1. Course(s) require you to complete the mandatory 2-hour zoom synchronous session to be eligible for transcripted credit
        2. Failure to complete the required 2-hour zoom synchronous session will result in your course being ineligible for completion. 
      • 2-hour Zoom Synchronous Session: hosted on select dates during each Term
        1. Minimum: 5* registrants per Zoom synchronous session
        2. Maximum: 45 registrants per Zoom synchronous session
      • *If the minimum parameter is not met for the selected Zoom synchronous session, the Zoom synchronous session will be canceled by Teaching Channel. Registrants may select an alternate available Zoom synchronous session within their selected term, re-register for a future term free of charge or receive a full refund upon request.
        You are responsible for completing your course within the term for which you registered.
        1. Spring Term: Coursework due April 15 – or next business day
        2. Summer Term: Coursework due August 15 – or next business day
        3. Fall Term: Coursework due November 15 – or next business day
      • Please note: you may register for and complete up to 15 credits per session (term) (dependent upon University Partner selection).
  3. Payment Terms

    You agree that you will pay for use of the System and for all courses in which you enroll through the Site, and that Learners Edge may charge/debit your credit card or other designated payment method for any System use or course enrollment, and for any additional amounts (including any taxes, fees, or other charges) that may be accrued by or in connection with your use of the System or course enrollment. The total price to you for System use or course enrollment will include applicable taxes, if any, based on the bill-to address provided by you. Given the nature of digital content, all sales are final.

    If a textbook is required, standard shipping is included. Your textbook(s) will be mailed to the shipping address provided at the time of registration. If the address provided is incorrect, you are responsible for secondary shipping and textbook charges to re-send the textbook(s).

    If shipping internationally, please note delivery timelines and estimates may be exceptionally long and Learners Edge is not responsible for delayed materials or those held in customs.

    You are responsible for the timely payment of all fees and for providing Learners Edge with a valid payment method for payment. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.

    Please be aware, full payment must be received within your selected term window to earn credit and a grade for all registered courses. Regardless of grade earned, full payment is required. Incomplete or failed payment(s) will not constitute a void or cancellation of your registration. If you are registered for courses beyond the 30-day cancellation window, you are financially responsible for full course payment.

  4. Cancellation & Refund Policy

    Without limiting any of the forgoing, our refund policy lasts 30 days. To be eligible for a refund or credit (as further described below), you must notify us in writing within 30 days of registering for a course at [email protected] with the stated reason for your cancellation. Unfortunately, we cannot offer you a refund or further credit toward Teaching Channel courses if 30 days have passed since you have registered for a course.

    Refund eligibility is null and void, regardless of days since registration, if coursework has been submitted in any progress checks and/or modules.

    If you are requesting a refund, your refund will be processed, less a $50 per course cancellation fee, and a credit for the remaining amount will be applied to your credit card or original method of payment within 30 days of approval of your request. Please note, priority shipping charges (if applicable) are non-refundable. If requesting a partial cancellation from a multiple course registration in which a single course remains, this constitutes forfeiture of the multicourse discount and the refund amount will reflect the adjustment for the standard course price for the remaining course.

    If you are requesting credit toward another Teaching Channel course, we will be happy to assist you in enrolling in a course that you believe will better suit your needs, provided that the substituted course is of the same format, credit level and same term of registration. You are responsible for securing the required course text(s) and for any additional costs or fees applicable to a substituted course.

        1. Continuing Education Courses (OL)
          If you are unable to complete the course in the term elected at registration, you may elect to use the one-time re-registration option for your course. If utilizing this option, you are responsible for a re-registration fee of $50 per credit, per course to enroll in a future term. Please note, the re-registration option is available for up to one year from your original registration date.

        2. Fast Track Courses (FT)
          If you are unable to complete the course in the term elected at registration, you may elect to use the one-time re-registration option for your course. If utilizing this option, you are responsible for a re-registration fee of $50 per credit, per course to enroll in a future term. Please note, the re-registration option is available for up to one year from your original registration date.

        3. Hybrid/Blended Learning Courses (OS)
          To earn a grade for the Hybrid/Blended course(s) in which you are registered, you must register separately for and attend one 2-hour Zoom synchronous session. If you cannot attend the Zoom synchronous session, you must cancel using the cancellation link on the confirmation email you received from Zoom. If canceling, be sure to re-register for a different Zoom synchronous session available within your elected term.
          If you are unable to complete the course in the term elected at registration, you may elect to use the one-time re-registration option for your course. If utilizing this option, you are responsible for a re-registration fee of $50 per credit, per course to enroll in a future term. Please note, the re-registration option is available for up to one year from your original registration date.

    Teaching Channel reserves the right to deny any refund or credit request in its sole discretion. 

B. Individual Course Bundle(s) Purchase Terms & Conditions

    1.  2 Course American College of Education Bundle

      1. Curriculum

        Continuing education graduate-level courses completed through Teaching Channel and American College of Education are intended to fulfill requirements for license renewal and/or salary advancement. Teaching Channel courses have proven successful for contractual lane changes in thousands of districts in the United States. Districts and states have different requirements for license renewal and salary advancement; you may need to check with district personnel to gain prior approval.

      2. Term Details

        • Summer Term: Coursework due August 15 – or next business day
        • Fall Term: Coursework due November 15 – or next business day
        • Spring Term: Coursework due April 15 – or next business day
        • You are responsible for completing your course(s) within the term for which you selected your course(s). You have 12 months to select your 2 courses. You can select from more than 115 3-credit courses approved by American College of Education.
        • Please note Fast Track and Hybris/Blended Learning courses are not eligible for bundle purchases. You may register for a maximum of 15 credit hours per term. Additionally, you may register for a maximum of 45 credit hours over three consecutive terms.
      3. Payment Terms

        You agree that you will pay for use of the Platform and for all courses in which you enroll through the Site, and that Teaching Channel may charge/debit your credit card or other designated payment method for any Platform use or course enrollment, and for any additional amounts (including any taxes, fees, or other charges) that may be accrued by or in connection with your use of the Platform or course enrollment. The total price to you for Platform use or course enrollment will include applicable taxes, if any, based on the bill-to address provided by you. Given the nature of digital content, all sales are final.

        Regardless of grade earned, full payment is required. Incomplete or failed payment(s) will not constitute a void or cancellation of your registration.

        If a textbook is required, standard shipping is included. Your textbook(s) will be mailed to the shipping address provided at the time of registration. If the address provided is incorrect, you are responsible for secondary shipping and textbook charges to re-send the textbook(s).

        Shipping to international addresses is not available for Bundle purchases.

        You are responsible for the timely payment of all fees and for providing Teaching Channel with a valid payment method for payment. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.

        You may register for a second ACE 2 Course Bundle upon successful completion of all Bundle payments and course selections in your first Bundle.

        1. Pay in Full Overview
          You are agreeing to make 100% payment for the bundle product and declining to enroll in the Pay as You Learn payment plan.
        2. Pay as You Learn Payment Plan
          You have selected the Teaching Channel Payment Plan – Pay as You Learn. You agree to make 100% payment for your purchased bundle product over 12 monthly payments.

          By selecting the Pay as you Learn payment plan, you agree to pay monthly payments for 12 months. Additionally, you agree to pay a one-time, non-refundable payment plan processing fee of $35 at time of purchase. You will receive monthly payment confirmation statements via e-mail and can access payment receipts within your Account by selecting Orders. A $15 late fee for each missed payment(s) due to credit card or debit card processing errors will be assessed. Teaching Channel will waive your first missed payment fee if it is corrected and paid within seven business days. You may choose to make advanced payments in your schedule or pay your outstanding balance in full at any time within the 12-month payment plan window. If electing to process advanced payments, your additional payments would be applied in reverse order to your outstanding scheduled payments.

          You may select a Teaching Channel Pay as You Learn Payment Plan for 2 bundle purchases during each/a 12-month period. You are limited to selecting 1 Teaching Channel Pay as You Learn payment plan for Bundle registrations per order. You may have up to 2 separate and active Pay as You Learn payment plans at any time.

      4. Bundle Cancellation & Refund Policy

        Cancellations received in writing via email or chat within 30 days will be eligible for a refund. If you selected Pay in Full, your refund will be processed, less a $100 Bundle cancellation fee. Credit for the remaining amount will be applied to your credit card or original method of payment within 30 days. If you selected the Pay as you Learn payment plan AND cancel within 30 days, you will be responsible for the non-refundable bundle cancellation fee of $100 and the non-refundable one-time payment plan processing fee of $35 for a total of $135 (full cancellation fee due prior to cancellation of scheduled payment plan). No refunds will be made for cancellations received 30 days after your purchase date. If you selected the Pay as you Learn payment plan and your cancellation was received 30 days after your purchase date your obligation to complete your 12 monthly payments remains. Teaching Channel reserves the right to suspend indefinitely any account that has missed 2 or more consecutive payments or is delinquent for 45 consecutive days.

        If you are unable to complete the course in the term elected at registration, you may elect to use the one-time re-registration option for your course. If utilizing this option, you are responsible for a re-registration fee of $150 per course to enroll in a future term. Please note, the re-registration option is available for up to one year from your original registration date.

        In the event the payment plan is not completed in its entirety, you will be charged the adjusted course price of $475 per selected course plus a $50 per course cancellation fee for any unselected courses.

      5. Course Grade Reporting

        1. Grade Reporting: Pay in Full
          Your course grades will be available upon successful completion of your course and in alignment with your term grade reporting dates.
        2. Grade Reporting: Pay as You Learn Payment Plan
          • First Course – Your course grade will be available upon successful completion of your course, 6 monthly payments, and in alignment with your term grade reporting date. 
          • Second Course – Your course grade will be available upon successful completion of your course, 12 monthly payments, and in alignment with your session (term) grade reporting date.
    2.   3 Course American College of Education Bundle

      1. Curriculum

        Continuing education graduate-level courses completed through Teaching Channel and American College of Education are intended to fulfill requirements for license renewal and/or salary advancement. Teaching Channel courses have proven successful for contractual lane changes in thousands of districts in the United States. Districts and states have different requirements for license renewal and salary advancement; you may need to check with district personnel to gain prior approval.

      2. Term Details

        • Summer Term: Coursework due August 15 – or next business day
        • Fall Term: Coursework due November 15 – or next business day
        • Spring Term: Coursework due April 15 – or next business day
        • You are responsible for completing your course(s) within the term for which you selected your course(s). You have 12 months to select your 3 courses. You can select from more than 115 3-credit courses approved by American College of Education.
        • Please note Fast Track and Hybris/Blended Learning courses are not eligible for bundle purchases. You may register for a maximum of 15 credit hours per term. Additionally, you may register for a maximum of 45 credit hours over three consecutive terms.

If you selected the Pay as you Learn payment plan AND cancel within 30 days, you will be responsible for the non-refundable bundle cancellation fee of $150 and the non-refundable one-time payment plan processing fee of $35 for a total of $185 (full cancellation fee due prior to cancellation of scheduled payment plan). No refunds will be made for cancellations received 30 days after your purchase date. If you selected the Pay as you Learn payment plan and your cancellation was received 30 days after your purchase date your obligation to complete your 12 monthly payments remains. Teaching Channel reserves the right to suspend indefinitely any account that has missed 2 or more consecutive payments or is delinquent for 45 consecutive days.

        If you are unable to complete the course in the term elected at registration, you may elect to use the one-time re-registration option for your course. If utilizing this option, you are responsible for a re-registration fee of $150 per course to enroll in a future term.         In the event the payment plan is not completed in its entirety, you will be charged the adjusted course price of $475 per selected course plus a $50 per course cancellation fee for any unselected courses.

      5. Course Grade Reporting

        1. Grade Reporting: Pay in Full
          Your course grades will be available upon successful completion of your course and in alignment with your term grade reporting dates.
        2. Grade Reporting: Pay as You Learn Payment Plan
          • First Course – Your course grade will be available upon successful completion of your course, 5 monthly payments, and in alignment with your term grade reporting date. 
          • Second Course – Your course grade will be available upon successful completion of your course, 9 monthly payments, and in alignment with your session (term) grade reporting date.
          • Third Course – Your course grade will be available upon successful completion of your course, completion of 12 monthly payments (all) and in alignment with your session (term) grade reporting date.

    3. Fast Track Bundle: Term Details

      Fast Track Bundle Term is determined based on the date of Bundle registration. Course selection must be completed within the associated term dates listed below.  

      1. Spring Fast Track Term:
        1. Bundle Registration Dates: January 2nd – May 15th
        2. Course Selection Dates: January 2nd – May 15th
        3. Coursework Due Date: May 30th (or next business day)
        4. You are responsible for selecting and completing your course(s) within the term for which you registered your Bundle.
      2. Summer Fast Track Term:
        1. Bundle Registration Dates: May 16th – August 15th
        2. Course Selection Dates: May 16th – August 15th
        3. Coursework Due Date: August 30th (or next business day)
        4. You are responsible for selecting and completing your course(s) within the term for which you registered your Bundle.
      3. Fall Fast Track Term:
        1. Bundle Registration Dates: August 16th – November 25th
        2. Course Selection Dates: August 16th – November 25th
        3. Coursework Due Date: December 9th (or next business day)
        4. You are responsible for selecting and completing your course(s) within the term for which you registered your Bundle.
      4. You may register for a maximum of 15 credit hours per term. Additionally, you may register for a maximum of 45 credit hours over three consecutive terms.
      5. Payment Terms

        You agree that you will pay for use of the Platform and for all courses in which you enroll through the Site, and that Teaching Channel may charge/debit your credit card or other designated payment method for any Platform use or course enrollment, and for any additional amounts (including any taxes, fees, or other charges) that may be accrued by or in connection with your use of the Platform or course enrollment. The total price to you for Platform use or course enrollment will include applicable taxes, if any, based on the bill-to address provided by you. Given the nature of digital content, all sales are final.

          By selecting the Pay as you Learn payment plan, you agree to pay monthly payments for 12 months. Additionally, you agree to pay a one-time, non-refundable payment plan processing fee of $35 at time of purchase. You will receive monthly payment confirmation statements via e-mail and can access payment receipts within your Account by selecting Orders. A $15 late fee for each missed payment(s) due to credit card or debit card processing errors will be assessed. You are limited to selecting 1 Teaching Channel Pay as You Learn payment plan for Bundle registrations per order. You may have up to 2 separate and active Pay as You Learn payment plans at any time.

      6. Bundle Cancellation & Refund Policy

        Cancellations received in writing via email or chat within 30 days will be eligible for a refund. If you selected Pay in Full, your refund will be processed, less a $150 Bundle cancellation fee. If you selected the Pay as you Learn payment plan and cancel within 30 days, you will be responsible for the non-refundable bundle cancellation fee of $150 AND the non-refundable one-time payment plan processing fee of $35 for a total of $185 (full cancellation fee due prior to cancellation of scheduled payment plan). Credit for the remaining amount will be applied to your credit card or original method of payment within 30 days. No refunds will be made for cancellations received 30 days after your purchase date. If you selected the Pay as you Learn payment plan and your cancellation was received 30 days after your purchase date your obligation to complete your 12 monthly payments remains. Teaching Channel reserves the right to suspend indefinitely any account that has missed 2 or more consecutive payments or is delinquent for 45 consecutive days.

        If you are unable to complete the course(s) in the term elected at registration, you may elect to use the one-time re-registration option for your course. If utilizing this option, you are responsible for a re-registration fee of $150 per course to enroll in a future term. Please note, the re-registration option is available for up to one year from your original registration date.

        In the event the payment plan is not completed in its entirety, you will be charged the adjusted course price of $525 per selected course plus a $50 per course cancellation fee for any unselected courses.
      7. Course Grade Reporting

        1. Grade Reporting: Pay in Full
          Your course grades will be available upon successful completion of your course and in alignment with your term grade reporting dates.
        2. Grade Reporting: Pay as You Learn Payment Plan
          • First Course – Your course grade will be available upon successful completion of your course, 5 monthly payments, and in alignment with your term grade reporting date. 
          • Second Course – Your course grade will be available upon successful completion of your course, 9 monthly payments, and in alignment with your session (term) grade reporting date.
          • Third CourseYour course grade will be available upon successful completion of your course, completion of 12 monthly payments (all) and in alignment with your session (term) grade reporting date.

            You may choose to make advance payments in your schedule or pay your outstanding balance in full at any time within the 12-month payment plan window. If electing to process advanced payments, your additional payments would be applied in reverse order to your outstanding scheduled payments. 

    4. 5 Course Lane Change Bundle

      1. Curriculum

        Continuing education graduate-level courses completed through Teaching Channel and the accredited University Partner are intended to fulfill requirements for license renewal and/or salary advancement. Teaching Channel courses have proven successful for contractual lane changes in thousands of districts in the United States. Districts and states have different requirements for license renewal and salary advancement; you may need to check with district personnel to gain prior approval.

      2. Term Details

        • Summer Term: Coursework due August 15 – or next business day
        • Fall Term: Coursework due November 15 – or next business day
        • Spring Term: Coursework due April 15 – or next business day
        • You are responsible for completing your course(s) within the term for which you selected your course(s). You have 12 months to select your 5 courses. You can select from more than 125 3-credit courses approved by participating university partners.
          Please note Fast Track and Hybrid/Blended Learning courses are not eligible for bundle registrations.
          Please note, you may register for a maximum of 15 credit hours per session term. Additionally, you may register for a maximum of 45 credit hours over three consecutive terms. University Partner selection may not be changed once registration is complete.

        1. Pay in Full Overview
          You are agreeing to make 100% payment for the bundle product and declining to enroll in the Pay as You Learn payment plan.
        2. Pay as You Learn Payment Plan
          You have selected the Teaching Channel Payment Plan – Pay as You Learn. You agree to make 100% payment for your purchased bundle product over 12 monthly payments.
          By selecting the Pay as you Learn payment plan, you agree to pay monthly payments for 12 months. Credit for the remaining amount will be applied to your credit card or original method of payment within 30 days. If you selected the Pay as you Learn payment plan AND cancel within 30 days, you will be responsible for the non-refundable bundle cancellation fee of $250 and the non-refundable one-time payment plan processing fee of $35 for a total of $285 (full cancellation fee due prior to cancellation of scheduled payment plan).No refunds will be made for cancellations received 30 days after your purchase date. If you selected the Pay as you Learn payment plan and your cancellation was received 30 days after your purchase date, your obligation to complete your 12 monthly payments remains. Teaching Channel reserves the right to indefinitely suspend any account that has missed 2 or more consecutive payments or is delinquent for 45 consecutive days.

        If you are unable to complete the course in the term elected at registration, you may elect to use the one-time re-registration option for your course.

        In the event the payment plan is not completed in its entirety, you will be charged the adjusted course price of $475 per selected course $50 per course cancellation fee for any unselected courses.

      5. Course Grade Reporting

        1. Grade Reporting: Pay in Full
          Your course grades will be available upon successful completion of your course and in alignment with your term grade reporting dates.
        2. Grade Reporting: Pay as You Learn Payment Plan
          • First Course – Your course grade will be available upon successful completion of your course, 3 monthly payments, and in alignment with your term grade reporting date.
          • Second Course –Your course grade will be available upon successful completion of your course, 5 monthly payments, and in alignment with your term grade reporting date.
          • Third Course – Your course grade will be available upon successful completion of your course, 7 monthly payments, and in alignment with your term grade reporting date.
          • Fourth Course – Your course grade will be available upon successful completion of your course, 10 monthly payments, and in alignment with your term grade reporting date.
          • Fifth Course – Your course grade will be available upon successful completion of your course, completion of all payments and in alignment with your term grade reporting date.
      6. University Partner Selection

        In the event that Learners Edge and the university partner you selected discontinue a working partnership, you will need to select a new university partner from our active university partner list. You will be responsible for any price increase and may be eligible for a refund based on the new bundle price associated with your updated university partner selection.

    5. 10 Course Lane Change Bundle 

      1. Curriculum

        Continuing education graduate-level courses completed through Teaching Channel and the accredited University Partner are intended to fulfill requirements for license renewal and/or salary advancement. Teaching Channel courses have proven successful for contractual lane changes in thousands of districts in the United States. Districts and states have different requirements for license renewal and salary advancement; you may need to check with district personnel to gain prior approval.

      2. Term Details

        • Summer Term: Coursework due August 15 – or next business day
        • Fall Term: Coursework due November 15 – or next business day
        • Spring Term: Coursework due April 15 – or next business day
        • You are responsible for completing your course(s) within the term for which you selected your course(s). You have 12 months to select your 5 courses. You can select from more than 125 3-credit courses approved by participating university partners.
          Please note Fast Track and Hybrid/Blended Learning courses are not eligible for bundle registrations.
          Please note, you may register for a maximum of 15 credit hours per term. Additionally, you may register for a maximum of 45 credit hours over three consecutive terms. University Partner selection may not be changed once registration is complete.
      3. Payment Terms

        You agree that you will pay for use of the Platform and for all courses in which you enroll through the Site, and that Teaching Channel may charge/debit your credit card or other designated payment method for any Platform use or course enrollment, and for any additional amounts (including any taxes, fees, or other charges) that may be accrued by or in connection with your use of the Platform or course enrollment.         Regardless of grade earned, full payment is required. Incomplete or failed payment(s) will not constitute a void or cancellation of your registration.

        If a textbook is required, standard shipping is included. Your textbook(s) will be mailed to the shipping address provided at the time of registration. If the address provided is incorrect, you are responsible for secondary shipping and textbook charges to re-send the textbook(s).

        Shipping to international addresses is not available with Bundle registrations.

          You have selected the Teaching Channel Payment Plan – Pay as You Learn. You agree to make 100% payment for your purchased bundle product over 12 monthly payments.
          By selecting the Pay as you Learn payment plan, you agree to pay monthly payments for 12 months. Additionally, you agree to pay a one-time, non-refundable payment plan processing fee of $35 at time of purchase. Please note, the re-registration option is available for up to one year from your original registration date.

        In the event the payment plan is not completed in its entirety, you will be charged the adjusted course price of $475 per selected course $50 per course cancellation fee for any unselected courses.

      5. Course Grade Reporting

C. Individual Continuing Education Flex Credit Course(s)/(Non-Credit) Purchase Terms & Conditions

  1. Curriculum

    Continuing education graduate-level courses completed through Teaching Channel as Flex Credit, are intended to fulfill requirements for license renewal. Please note Flex Credit courses do not receive a transcript. Flex credit courses receive a Letter of Completion noting hours of completion only. Student(s) do have an option to pay an additional upgrade fee to receive graduate-level continuing education credit with a university transcript. Please see upgrade terms and conditions below for Flex Credit Courses.

    Term Details

    • Spring Term: Coursework due April 15 – or next business day
    • Summer Term: Coursework due August 15 – or next business day

    Without limiting any of the foregoing, our refund policy lasts 30 days. To be eligible for a refund or credit (as further described below), you must notify us in writing within 30 days of registering for a course at [email protected]. Unfortunately, we cannot offer you a refund or further credit toward Teaching Channel courses if 30 days have passed since you have registered for a course. You are responsible for a re-registration fee of $75 if you change your course term after 30 days of your initial purchase date. 
    If you are requesting a refund, your refund will be processed, less a $50 per course cancellation fee, and a credit for the remaining amount will be applied to your credit card or original method of payment within 30 days of approval of your request.

    If you are requesting credit toward another Teaching Channel course, we will be happy to assist you in enrolling in a course that you believe will better suit your needs for no additional fee, provided that the substituted course is of the same type, price, and total hours. You are responsible for any additional costs or fees applicable to a substituted course. 

    If you are unable to complete the course in the term elected at registration, you may elect to use the one-time re-registration option for your course. If utilizing this option, you are responsible for a re-registration fee of $75 per course to enroll in a future term.   4. Credit Upgrade Option

    Teaching Channel courses have proven successful for contractual lane changes and salary advancement in thousands of districts in the United States. Districts and states have different requirements for license renewal and salary advancement; you may need to check with district personnel to gain prior approval.

    For each flex credit course completed, you have the option to upgrade and receive a transcript for credit by selecting an accredited University Partner and paying the additional upgrade charge. The credit upgrade must be purchased within six months of the end date for the term in which you completed your course. Contact our Support Team via phone or chat to process payment and upgrade to credit with a University Partner. 

    Credit upgrade pricing is the difference between what was paid for the initial flex credit course and graduate credit pricing at the time of the upgrade. Upgrade fees are non-refundable once purchased. Please note, credit upgrade fees are in addition to registration fees. Group, multi-course, and promotional discounts are not available on credit upgrade purchases.

        • A $99 initial charge and a $35 payment plan processing fee will be charged at checkout. The outstanding balance of your order (based on your closing group size), will be divided equally across the 11 remaining payments.
        • You must pay a non-refundable $35 Pay as You Learn payment plan processing fee at time of purchase.
        • You will receive monthly payment confirmation statements via e-mail and can access an updated payment receipt within your Account by selecting My Orders.

Please note, priority shipping charges (if applicable) are non-refundable.
      • If you are requesting a course exchange for another Teaching Channel course, we will be happy to assist you in enrolling in a course that you believe will better suit your needs, provided that the substituted course is of the same format, credit level and same term of registration. You are responsible for securing the required course text(s) and for any additional costs or fees applicable to a substituted course.
    2. Group Pay As You Learn Payment Plan Cancellation
      • Cancellations received in writing via email or chat within 30 days will be eligible for a partial refund. You will be responsible for the non-refundable course cancellation fee of $50 per course and the non-refundable one-time payment plan processing fee of $35 (full cancellation fee due prior to cancellation of scheduled payment plan). If your cancellation was received 30 days after your purchase date your obligation to complete your 12 monthly payments remains.   7. Course Grade Reporting

      • Course grades will be released in alignment with Term grade release dates AND monthly payments received.
      • Grade(s) will continue to be posted at each $475 payment interval reached until completion of all monthly payments. For example, a grade for your first completed course will be posted when your cumulative monthly payments meet or exceed $475. A grade for your second completed course will be posted when your cumulative payments meet or exceed $950.
      • Early payments can be made to release grades sooner. Please refer to the FAQ for detailed step-by-step instructions.

E. Individual Professional Development Course(s) Purchase Terms & Conditions

    Professional development courses completed through Teaching Channel are intended for use as professional growth and/or to fulfill requirements for license renewal. Districts and states have different requirements for license renewal; you may need to check with district personnel to gain prior approval. Professional development courses are considered complete when the participant has taken the final assessment and scored a passing score. This will release the letter of completion to document hours earned which can be found in the participant’s account.

F. Professional Development (“PD”) All-Access Package Terms & Conditions

  1. Curriculum

    The Teaching Channel All-Access PD Package is a 12-month all-access pass to our extensive professional development library of 2 to 10-hour courses plus our state-specific professional development courses. Participants can earn hundreds of hours of professional learning through high-quality relevant content featured in a variety of topical courses which are asynchronous, online, and allow for personalization of professional learning. Courses are resource-rich with journaling activities and an end-of-course assessment.

    Professional development courses completed through Teaching Channel are intended for use as professional growth and/or to fulfill requirements for license renewal. Districts and states have different requirements for license renewal; you may need to check with district personnel to gain prior approval. Professional development courses are considered complete when the participant has taken the final assessment and scored a passing score. This will release the letter of completion to document hours earned which can be found in the participant’s account. 

  2. Term Details

    You will have access to and may complete your PD All-Access Package professional development courses for up to one year from your purchase date. 
    You are responsible for completing your courses within 12 months of your registration date.

    You are responsible for the timely payment of all fees and for providing Teaching Channel with a valid payment method for payment. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.

    Please be aware, full payment must be received within your selected term window to earn a Teaching Channel Letter of Completion for all registered courses. Regardless of course completion status, full payment is required. Incomplete or failed payment(s) will not constitute a void or cancellation of your registration. If you are registered for courses beyond the 30-day cancellation window, you are financially responsible for full course payment.

  3. Professional Development (“PD”) All-Access Package Cancellation & Refund Policy

    Without limiting any of the foregoing, our refund policy lasts 30 days. To be eligible for a refund or credit (as further described below), you must notify us in writing within 30 days of registering for a course at [email protected] with the stated reason for your cancellation. Unfortunately, we cannot offer you a refund or further credit toward Teaching Channel courses if 30 days have passed since you have registered for a course or you have completed your course. Please note, cancellation is not available if two or more Package courses are completed. 

    If you request a refund, your refund will be processed, less a $100 cancellation fee, and a credit for the remaining amount will be applied to your credit card or original method of payment within 30 days of approval of your request. 
    Teaching Channel reserves the right to deny any refund or credit request in its sole discretion. 

Engage Video Library: Individual & Small Group Subscriptions:

  • The 3, 6, or 12-month Subscription fee will be the amount agreed to at the time of enrollment. Thereafter, Teaching Channel has the right to increase or decrease any such fee by providing you notice of such increase or decrease at least 60 days prior to the effective date of such change. If you elect for your Subscription to be automatically renewed as provided above, you hereby expressly authorize Teaching Channel to charge the applicable fees to the credit card you used to pay for your initial Subscription.
  • YOU ARE RESPONSIBLE FOR THE TIMELY PAYMENT OF ALL FEES AND FOR PROVIDING TEACHING CHANNEL WITH A VALID PAYMENT METHOD FOR PAYMENT. You agree to accept responsibility for all activities that occur under your account or password. On the registration payment page, you will be given the option to make a one-time payment or to have a set number of consecutive monthly charges/debits posted to your credit card or other designated payment method for your Platform use, video or content Subscription, Course enrollment, or other purchases on this Site. If you elect to terminate your authorization for extended payments all unpaid amounts will become immediately due and payable and will be immediately charged/debited to your credit card or other designated payment method. Notwithstanding any early termination of authorization, you remain liable for all charges due for Platform use, Subscription, Course enrollment, or other purchases made on this Site. Please be aware, full payment must be received within your selected term window to earn credit and a grade for all registered Courses. Regardless of grade earned, full payment is required. You will not be dropped from your Course(s) because of an incomplete payment. If you are registered for Courses beyond the 30 day cancellation window, you are financially responsible for full Course payment.
  • You agree that you will pay for use of our Platform and for all Subscriptions, Content, and Courses in which you enroll through the Site, and that Teaching Channel may charge/debit your credit card or other designated payment method for any such purchases, and for any additional amounts (including any taxes, fees, or other charges) that may be accrued by or in connection with your use of our Platform, Subscriptions, Content, or Course enrollment. The total price to you for such purchases will include applicable taxes, if any, based on the bill-to address provided by you. Prices may change at any time, and the prices set forth on the Site do not provide for price protection or for refunds in the event of any subsequent price reduction or promotional offering. Teaching Channel reserves the right, with or without prior notice, to limit or discontinue the availability of any product or service, and to not honor or otherwise impose additional conditions on any promotional code or limited promotions.
  • Given the nature of digital content, all sales of digital books and materials separate from a Course are final.
  • You may cancel a Subscription by notifying us in writing at [email protected] at least 30 days in advance of the end of the then-current Period. Unfortunately, we cannot offer a refund or credit for Teaching Channel Subscriptions fees that have already been charged.
  • Teaching Channel reserves the right to deny any refund or credit request in its sole discretion. Teaching Channel also reserves the right to modify its cancellation and refund policy at any time, or from time to time, by posting notice of same on this Site.
  • Individual purchasers of a pre-service teacher semester pass (6 months access) or pre-service teacher annual pass understand that the pricing is only valid for students actively enrolled in a college or university degree program. An individual that purchases this product without an active college or university email agrees to pay the difference between a full priced annual license or 6 month license and the amount already paid to maintain a valid license to the video library.
  • INDIVIDUAL SUBSCRIPTIONS SHALL BE AUTOMATICALLY ENROLLED IN AUTO-RENEWAL WHEN YOUR ORDER IS PLACED UNLESS OTHERWISE NOTED. When placing an Order for a Subscription, you will be automatically enrolled to have your Subscription automatically renew at the end of each time-bound Subscription period (“Period”) and your credit card will be charged the fee for the following Period 2 days in advance of the start of the next Period, unless you opt-out of the auto-renewal feature by changing your election on your My Orders page at least 2 days in advance of the expiration of the then-current Term.

Institution Purchases: Engage Feedback and other special services negotiated.

  • In the event that you have entered into a separate master license and use agreement with us, the terms of that agreement will be subject to the Terms, except as otherwise stated in such executed separate master license and use agreement.

This website (“Site”) is operated by Learners Edge, LLC (and its subsidiaries Teaching Channel, Inc., Lavinia Group, and Insight Education Group, collectively, with all of their subsidiaries and affiliates, “Teaching Channel,” “we” or “our”) to provide you with quality, impactful professional development resources. This Terms of Use Agreement (together with any documents referred to in them, including our Privacy Policy) (collectively, “Terms”) apply to ordering, purchasing, and participating in Teaching Channel courses (“Courses”), your use of our website or other services offered at www.TeachingChannel.org (which address, effective December 19, 2019, became www.TeachingChannel.com), our online education portal, and through any mobile application we develop utilizing the tools from this Site (collectively, with content, Software (defined below) and Courses and Course materials we provide, in whole or in part, our “Platform”). If you are accessing our Platform on behalf of, or for the purposes of, another person, including a business or other organization, “you” or “your” also means that other person, including a business organization. You represent and warrant to Teaching Channel that you are authorized to bind such other person to these Terms. Capitalized terms shall have the meaning set forth in these Terms.

IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT ACCESS THIS SITE. WHEN PLACING AN ORDER, YOU WILL NEED TO CONFIRM YOUR AGREEMENT TO THESE TERMS TO COMPLETE YOUR ORDER. We may revise and update these Terms in our sole discretion, and will post any updates to these Terms on this Site, so please review these Terms frequently. If we make material changes to these Terms, we may notify you here or by means of a notice on our home page. Your continued use of this Site or our Platform, or any other service provided through the Site or Platform, means that you accept and agree to the modified Terms. Teaching Channel makes no representation or warranty regarding access to content available through the Services, including the quality of streaming content and the download speed of downloadable content, as the quality (e.g., the resolution) of streaming content, as well as the download speed of downloadable content, may be affected by a variety of factors such as a user’s location, the content being streamed or downloaded and the speed of a user’s Internet connection. YOU ACKNOWLEDGE AND AGREE THAT TEACHING CHANNEL SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY MODIFICATION, SUSPENSION OR DISCONTINUANCE OF THIS SITE, OUR PLATFORM OR INFORMATION PROVIDED ON THIS SITE OR ACCESSED BY YOU THROUGH THIS SITE.

By using our Platform, you further agree that you will not use our Platform or any materials available hereon for any unlawful activity or use it in any way that would violate any of these Terms. When applicable, you further agree, as a condition of using our Platform, to ensure that all of your agents, employees and independent contractors adhere to these Terms.

In order to access certain portions of our Platform, and to register for a Course, you may be required to register by providing information in a form requested by Teaching Channel (“Registration Form”). Any contact information you provide may be used by us in accordance with our Privacy Policy, which also allows you to manage your email subscription preferences. Teaching Channel may accept or reject any Registration Form in its sole discretion. You represent that the information provided when registering is accurate, complete, and current and that you will update such information from time to time as necessary. These Terms shall be incorporated into, and form an integral part of, each Registration Form. As part of the registration process, your email address will serve as your user name (“User Name”), and a password will be selected by you (“Password”) to access your account. Your User Name and Password will be your credentials to access the restricted portions of this Site.

All of the information you provide during your registration process and submitted/graded coursework with Teaching Channel (except financial information) will be shared with instructors, evaluators, staff, and the chosen academic partner (university or college) out of the list of eligible partners in order to facilitate the registration process and your ability to request a transcript upon successful completion of your course with that university or college. We will also communicate with you, the student, on your coursework progress and final grade via the email that you provide during registration. Please see our Privacy Policy for a full description of the information we collect, use, manage, disclose and share.

You are solely responsible for all use of our Platform under your User Name and Password and for maintaining the confidentiality of your User Name and Password. You will promptly notify Teaching Channel of any actual or suspected unauthorized use of our Platform or your User Name or Password. If you cannot remember your Password, you will be prompted to reset your Password by following the instructions on the Login page. By establishing a User Name with Teaching Channel, and each time you access a Product or Service or submit an Order through this Site, you authorize Teaching Channel to contact you at your e-mail address. We may provide you with any notices under these Terms by means of a posting on our Platform, by email, or by sending a message to you through our Platform. To opt out of receiving marketing emails from us, follow the “unsubscribe” link on the email to change your user preferences or follow the procedures set forth in our Privacy Policy. However, there are certain system-generated and legal notices that you cannot opt out of without deactivating your account. As to your use of our Teaching Channel Plus products and services, we will not use, share, disseminate or otherwise distribute or reproduce User Content submitted on the Teaching Channel Plus platform or module via any other medium, except that we will use the User Content to provide you with the Teaching Channel Plus products and services you have requested.

IF YOU CHOOSE TO MAKE ANY OF YOUR PERSONALLY IDENTIFIABLE OR OTHER INFORMATION PUBLICLY AVAILABLE IN A FORUM, COURSE OR OTHERWISE ON THIS SITE, YOU DO SO AT YOUR OWN RISK.

Orders. The acceptance and fulfillment by Teaching Channel of any order (each, an “Order”) placed on our Platform for a Course, content bundles or the like, a time-bound subscription for videos, or other related content (each, a “Subscription”) is subject to your acceptance of and compliance with all of these Terms. To purchase any Course or Subscription on our Platform, you must be legally permitted to enter into a legally binding contract (at least eighteen (18) years old in most jurisdictions). Unless another payment method is agreed to by Teaching Channel, prior to the purchase of any Course or Subscription on our Platform, you must provide a valid credit card number and related payment information. By submitting that information to us or our third party payment processor, you hereby authorize Teaching Channel to charge your credit card for such purchases.
Unless you notify Teaching Channel in writing at [email protected] of any discrepancies in charges for Orders within thirty (30) days of the erroneous charge(s) appearing on your credit card statement, you agree that such charges will be deemed accepted by you for all purposes hereunder. Such notice shall describe the amount in dispute, and you further agree to provide Teaching Channel with any requested additional information and verifications concerning same. In the event Teaching Channel does not receive payment from your credit card issuer, you shall pay all amounts due upon demand by Teaching Channel. If Teaching Channel is unable to collect amounts owed on your accounts, Teaching Channel may refer those accounts to a collection agency, and you will be responsible for all costs of collection.

We may, without liability or obligation, in our sole discretion and at any time: (A) terminate these Terms or suspend your account at any time with or without notice to you in the event that you breach (or we reasonably suspects that you have breached) any provision of these Terms; (B) make modifications to, or discontinue, any Courses and/or Subscriptions with or without providing you with notice (except as we may expressly agree to provide you with notice elsewhere in these Terms); and/or (C) require you to use modified Courses or materials and/or a modified version of the Courses or materials in order to have continued access to the Courses and Subscriptions. The modifications may result in certain Courses or materials being unavailable, or incompatible with certain devices. Additionally, we may, in our discretion, impose additional time limits, platform restrictions or geographic or other restrictions on the availability of certain Courses. Teaching Channel controls its Platform (excluding linked sites) from the United States of America, and makes no representation that any content contained in the Platform is appropriate or available for use in other locations. Accessing the Platform in locations where the use of such content is illegal is prohibited. Further, we may terminate these Terms or suspend your account at any time if your employer elects to terminate either its use of our Platform or your use of the Platform, or if our agreement with your employer is terminated. We will have no liability or responsibility to you if we terminate these Terms, suspend your account or modify the Courses, Subscriptions or materials under this paragraph.

If we give you advanced notice, you shall promptly cease the use of, and destroy, all copies of any specified Courses or materials, or otherwise modify your usage as directed by us. You agree that neither we nor our affiliates shall be liable to you or to any third party for any modification, suspension or discontinuance of the Courses or materials.

Disclaimer

Continuing education graduate credit is intended to fulfill requirements for license renewal/lane change when the participant has obtained proper prior approval. Teaching Channel does not warrant or guarantee that our Courses will meet your intended needs. Many schools, districts, and states have different requirements for professional development. Check with your district personnel or state Department of Education to gain prior approval for the Teaching Channel Courses you purchase. Applicability and credit eligibility of our Courses is the sole responsibility of the participant. You are responsible for completing your Course(s) within the session for which you registered.

Pricing

All prices for any Course or Subscriptions on our Platform are quoted in U.S. currency unless otherwise noted, and are subject to change at any time without notice. Teaching Channel makes no representations or warranties regarding the availability of products and services in all areas. Teaching Channel shall have the right to refuse or cancel any Orders listed at an incorrect price, or containing any other incorrect information or typographical errors. Teaching Channel shall have the right to refuse or cancel any such Orders whether or not the Order has been accepted by Teaching Channel and/or your payment has been processed.

Promotional Codes

Certain Courses and Subscriptions may be eligible for promotional codes. We may send push notifications from time to time in order to update you about events or promotions. If you no longer wish to receive such communications, you may turn them off at the device level. The promotional code must be entered at checkout in order to be applied to your eligible order, and cannot be applied after an order is submitted. The promotional codes are promotional discount codes for eligible products, and have no cash redeemable value. Each promotional code can be used only once per user per account, unless otherwise specified, and are non-transferrable. Promotional code can only be redeemed online. The promotional codes are valid for a limited time only, and expire on the last day of the promotion period at 11:59 PM Eastern Standard Time (EST). Teaching Channel reserves the right to modify or cancel any promotional code at any time.

You must be 18 years or older to redeem a promotional code. Each promotional code is redeemable on select Courses or Subscriptions only, and may require a minimum dollar value purchase. Promotional codes cannot be used in combination with other discounts, coupons, promotions, shipping specials or other promotional code. Upon entering the promotional code and purchasing an eligible Course or Subscription, the promotional code will apply to both your initial Subscription period and any subsequent consecutive renewals of such Subscription unless modified or canceled by Teaching Channel or if you deactivate your account or cancel your auto-renewal feature found on your account page on this Site. If you purchase a subscription after deactivating or cancelling your account or the auto-renew feature, you will be charged at the then-current, non-promotional subscription rate.

Software

Any software that we make available to access or download from this Site (“Software”) or through your mobile application store, including the Teaching Channel mobile application (the “Mobile App”) is the copyrighted work of the Teaching Channel Companies and/or our respective suppliers. The Software and the Mobile App included in the definition of Platform hereunder. Your use of such Software is governed by the terms of the end user license agreement, if any, which accompanies, or is included with, the Software (each, a “License Agreement”). You may not install or use any Software that is accompanied by or includes a License Agreement unless you first agree to the License Agreement terms.

Any reproduction or redistribution of the Software is expressly prohibited, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible. Without limiting the foregoing, copying or reproduction of the Software to any other server or location for further reproduction or redistribution is expressly prohibited. The Software is warranted, if at all, only according to the terms of the applicable License Agreement.

Your mobile device must be connected to the Internet for the Mobile App to function correctly. You are responsible for making all arrangements necessary for your mobile device to have Internet connectivity and are responsible for all fees your service provider may charge you arising out of the Mobile App transmitting and receiving data (including but not limited to data roaming charges). As further described in our Privacy Policy, the Mobile App will automatically transfer relevant data as part of its normal operation, relating to how you use the Mobile App, which content you access, and technical errors or problems which the Mobile App may encounter while being used, including time stamps, version of Mobile App, the device’s Unique Device Identifier (or “UDI”), computer operating system you use (e.g., Android or iOS), installation data (e.g., daily installs, upgrades and uninstalls), Mobile App activity, and errorreporting information. By using the Mobile App, you expressly acknowledge, agree and consent to the automatic collection of this information.

Intellectual Property

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our Platform for your personal use only, subject to the payment of any applicable fees. As a condition of your use of our Platform, you warrant that you will not use our Platform for any purpose that is unlawful or prohibited by these Terms. You may not use our Platform in any manner which could damage, disable, overburden, or impair our Platform, or interfere with any other party’s use and enjoyment of our Platform. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through our Platform.

All content included as part of our Platform (other than User Content, which you license to us pursuant to these Terms), such as text, graphics, audio, video, logos, images, as well as the compilation thereof (including any translations thereof), and any software used on our Platform, is our property or the property of our affiliates, assigns, licensors, subsidiaries, suppliers and/or other providers, and is protected by copyright and other laws (including international laws) that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends, or other restrictions contained in any such content, and will not make any changes thereto. Title to our Platform and any portion thereof is retained by Teaching Channel or its affiliates, assigns, licensors, subsidiaries, suppliers and/or other providers and is furnished hereunder on a licensed basis as described herein.

You will not, and will not allow others to, modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content or software, in whole or in part, found on our Platform. Our Platform is not for resale. Your use of our Platform does not entitle you to make any unauthorized use of any content, and in particular you will not delete or alter any proprietary rights or attribution notices with any content or software. You will use our Platform solely for your personal use, and will make no other use of our Platform without our express written permission. You agree that you do not acquire any ownership rights in our Platform or any content thereon. We do not grant you any licenses, express or implied, to our intellectual property or our licensors, except as expressly authorized by these Terms.

Teaching Channel, the Teaching Channel logo and any other product or service name or slogan contained in the Site are trademarks of Teaching Channel and its suppliers or licensors, and may not be copied, imitated or used, in whole or in part, without the prior written permission of Teaching Channel or the applicable trademark holder. Teaching Channel is a trademark of Teaching Channel, Inc. All Rights Reserved. In addition, the look and feel of the Site and Platform, including all page headers, custom graphics, button icons and scripts, is the service mark, trademark, and/or trade dress of Teaching Channel and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names and company names or logos mentioned in the Site and Platform are the property of their respective owners.

In the event you violate any of the terms hereof, or if your Course or Subscription is not renewed, all rights and licenses granted to you hereunder shall immediately terminate.

User Contributions

To the extent portions of this Site allows you to comment or otherwise post videos, photos or other content on the Site (“User Content”), you may not post User Content that: 

  • violates any copyright, trademark rights, patent rights, rights in know-how, privacy or publicity rights, trade secret rights, confidentiality rights, contract rights, or other rights of any individual or legal entity; 
  • is harmful; hateful; threatening; abusive; harassing; defamatory or libelous; sexually explicit, vulgar, lewd, obscene, or pornographic; racially, ethnically, or otherwise objectionable or offensive, inappropriate, inflammatory, or that invades the privacy or violates any personal right of any person or entity; 
  • you know (or reasonably should know) is false, deceptive, or misleading; 
  • contains information that could be used for identity theft purposes, such as social security numbers, credit card, bank account, or other financial information, driver’s license numbers, security codes, or passwords; 
  • links to materials or other content, directly or indirectly, to which you do not have a right to link or that violates these restrictions;
  • violates any applicable local, state, national, or international law; or
  • contains any viruses or other malware.

All videos and photos you submit must also be in accordance with the following:

  • All photos must be relevant to Teaching Channel or our Platform.
  • Do not submit photos or information about children or any third parties without their express consent (or their parent’s consent in the case of a child).
  • Submit only your own photos – do not submit photos from any other source, either personal or commercial.
  • Do not submit photos that include logos, branding, promotional material or any other content intended for commercial purposes.

Use of User Content on our Platform

All User Content generated, produced or created by you is your property and continues to be your property after you have submitted the User Content on our Platform. By posting User Content on our Platform, you (A) represent and warrant that the posting of such User Content does not violate these Terms or applicable laws, including export control laws and regulations, and (B) grant us and our affiliates an irrevocable, non-exclusive, worldwide, fully paid-up and royalty-free, transferable and sublicensable license to copy, display, upload, adapt, perform, publish, distribute (through multiple tiers of distribution and partnerships), store, modify and otherwise use and fully exploit such User Content, in whole or in part, throughout the universe in any form, format, or medium now or hereafter known, for the purpose of providing the Teaching Channel products and services you have requested, to create new Teaching Channel products and services, to market Teaching Channel products and services to you or for any other reasons the Teaching Channel deems appropriate in its sole discretion.

Teaching Channel does not and shall not have any obligation to review User Content, and therefore we do not guarantee the accuracy, integrity, or quality of User Content and we cannot assure you that harmful, inaccurate, deceptive, offensive, threatening, defamatory, unlawful, or otherwise objectionable User Content will not appear on our Platform. We do, however, reserve the right to review any or all User Content in our sole discretion. In addition, we reserve the right to alter, edit, or remove any User Content, in whole or in part, at our sole discretion. You will be held liable for any illegal or prohibited User Content you provide to this Site, including among other things, infringing, defamatory or offensive materials. If you discover this kind of material on this Site, please notify us immediately at [email protected]. We will investigate your claim promptly and may then take the actions we deem appropriate.

UNDER NO CIRCUMSTANCES SHALL TEACHING CHANNEL OR ITS AFFILIATES BE LIABLE IN ANY WAY FOR ANY USER COMMENTS POSTED ON OR MADE AVAILABLE THROUGH THE PLATFORM. We do not control, have no obligation to monitor, and are not responsible for what users post, and are not responsible for any offensive, inappropriate, obscene, unlawful, infringing, or otherwise objectionable or illegal User Content on our Platform. Teaching Channel claims no ownership, affiliation with or endorsement of any photos that are submitted by users through our Sites.

Digital Millennium Copyright Act Policy

Our policy is to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (“DMCA”). In accordance with the DMCA and other applicable law, Teaching Channel has adopted a policy of terminating the accounts of, in appropriate circumstances and at Teaching Channel’s sole discretion, subscribers who are deemed to be repeat infringers. Teaching Channel may also, at its sole discretion, limit access to this Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement. You may not submit a copyright claim on behalf of another individual or organization with which you have no affiliation. 
Notifications of claimed copyright infringement should be sent to the Site’s designated agent (see below). ALL INQUIRIES NOT RELEVANT TO OR NOT COMPLYING WITH THE FOLLOWING PROCEDURE WILL RECEIVE NO RESPONSE. Teaching Channel will process and investigate notices (each, a “Notice”) of alleged infringement and will take appropriate actions under the DMCA and other applicable intellectual property laws.   • a description of the copyrighted work that you claim has been infringed;
  • a description of where the material that you claim is infringing is located on the Site;
  • your address, telephone number and e-mail address, and all other information reasonably sufficient to permit Teaching Channel to contact you;

We reserve the right to block access to or cancel any Order for any user known or reasonably believed to be in violation of this provision.

Indemnification

You agree to indemnify, defend, and hold harmless Teaching Channel, its and its affiliates’, officers, directors, employees, agents, and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of or inability to access and use our Platform or any part thereof, any claim that your User Content violates the intellectual property rights of a third party, your violation of these Terms, or your violation of any rights of a third party or your violation of any applicable laws, rules, or regulations. Remedies

You understand and agree that any unauthorized use of our Platform would result in irreparable injury to us for which money damages would be inadequate, and in such event we will have the right, in addition to other remedies available at law and in equity, to immediate injunctive relief against you. Nothing contained in this paragraph or elsewhere in these Terms shall be construed to limit remedies or relief available pursuant to statutory or other claims that we may have under separate legal authority, including but not limited to, any claim for intellectual property infringement.

U.S. Government Restricted Rights

All Materials supplied by or through our Platform are provided with “RESTRICTED RIGHTS.” Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in FAR52.22724 and DFAR252.227-7013 et seq. or its successor. Use of any of such by the Government constitutes acknowledgment of our and its licensors’ proprietary rights therein. In the event that the Terms, or any part thereof, is deemed inconsistent with the minimum rights identified in the Restricted Right provisions, the minimum rights shall prevail.

Governing Law, Venue and Jurisdiction

These Terms shall be treated as though they were executed and performed in Minnesota and shall be governed by the laws of the State of Minnesota and the laws of the United States without regard to conflict of law principles. Any claim or dispute related to our Platform or under these Terms of Use, the Privacy Policy, and any legal notices on this Platform, must be instituted within one (1) year after the claim arose (if multiple claims, from the date the first claim arose), or be forever waived and barred. You agree that you will bring any claims in, and submit to the exclusive jurisdiction of, the state and federal courts located in the County of Hennepin, in the State of Minnesota.

Arbitration

PLEASE READ THIS CAREFULLY. WE WANT YOU TO KNOW HOW IT AFFECTS YOUR RIGHTS. By using this Site, you agree that Teaching Channel, at its sole discretion, may require you to submit any disputes arising from the use of this Site, or these Terms concerning or, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance or termination, to final and binding arbitration under the International Rules of Arbitration of the American Arbitration Association, by one or more arbitrators appointed in accordance with the said Rules. Notwithstanding these rules, however, such proceeding shall be governed by the laws of the state as set forth above. Any award in an arbitration initiated under this clause shall be limited to monetary damages (as further limited herein) and shall include no injunction or direction to any party other than the direction to pay a monetary amount. Further, the arbitrator(s) shall have no authority to award punitive, consequential or other damages not measured by the prevailing party’s actual damages in any arbitration initiated under this section, except as may be required by statute.

Survival

As further described below: You, as a Subscriber, must have an active license and your account must be in good standing with Tch to access and view any Tch content; and you are prohibited from sharing Tch content with non-Subscribers.

This is notice of the Terms and Conditions between Teaching Channel, Inc., with an address of Grand Oak Business Park, 2805 Dodd Road, Suite 200, Eagan, MN 55121 (“Tch”) and you and any Teaching Channel user (“Subscriber” ). Tch owns and operates a web site and service currently located at www.teachingchannel.com (the “Tch Site”) that provides a resource for educators. Subscribers have accessed and used the Tch Site, and have therefore agreed to the Terms of Use (including the Privacy Policy) (collectively, the “Terms of Use”) set forth therein. Tch also offers schools, districts, and education organizations the ability to access the Teaching Channel Dedicated Platform, a private collaboration platform for enabling teachers and teacher leaders to work together, which includes a robust library of videos that the organization can add to and customize, and Subscribers can create areas within the Tch Site of Subscriber’s own users (which, for clarity, are other Subscribers) and content (collectively, the “Tch Platform”). As described in the Terms of Use, Subscribers’ instances or accounts can be subject to termination if not properly used or unlawfully shared, or for any other reason Tch deems appropriate, in its sole discretion. If you are receiving this notice, you are a Subscriber and, upon the continued use of the Tch Site and the Tch Platform, you hereby agree to the Terms of Use and this notice.

In addition to confirming your agreement to the Terms of Use, this notice services to inform you that copyright laws apply to original works to control how they are used and if it can be copied, whether marked with a “©” or not. Pursuant to such laws, unauthorized use of such works can result in copyright infringement, which can lead to legal challenges. Legal rights to acquire use of Teaching Channel’s videos via the Tch Site is only granted when a subscription license has been purchased by you, a Subscriber, per applicable Subscriber. Any videos being viewed or broadcasted must be viewed or broadcasted to exclusive individual Subscriber accounts, each containing individual usernames and passwords (and/or SSO and URL license agreements) in the form of written consent agreements. The law states, and Tch requires, that you, the Subscriber, and other Subscribers, always need permission from the copyright owner for any content not created by yourself that is shared with others.
